Things that make me smile.


As the holidays are here, wanted to share a doodle of my dog, Scooter, that I sketched as he looked over me to comfort, stand guard, protect, during a hard time.  Scooter is a mini schnauzer and has served as an incredible support over the past six years.  Since adopting him as a puppy, at about the same time my mom was diagnosed with terminal cancer, Scooter has provided much support and strength.  Thanks Scoots for keeping life goofy, real, fun, real fun, really goofy, sincere, genuine and honest. mini schnauzer, Scooter, dog

Benedict History: Einstein to Sagan


My mom Leeanna Ruth Mickelson Benedict speaks with astrophysict Carl Sagan.

My grandpa, Anthony Gorman Benedict, youngest to be accepted to Cal Tech in the 1930’s and considered a genius.  Once stumped Einstein and the later was proved true ;-) 
I met w Cal Tech professors this summer of 2017 who unanimously proclaimed my grandfather was correct in his question and Einstein wrong. The proposed question later led to the discovery of the Richter Scale as we know today to measure earthquakes.  The modern analysis of this letter from the most brilliant minds at Cal Tech - the same ones whove discovered Planet 9 recently. Commissioner Carlos Velategui yells that the opposing party is "Finished" when they are not even present.

July 26, 2017, King County Superior Court Probate hearing with Washington State Attorney Kenyon Luce #3081 before Commissioner Carlos Velategui in ex parte probate court.  Commissioner thinks microphone is off at the end and tells Mr. Luce that, by his award of $24,654,01, that the heir to the estate cannot proceed any longer in court, "She's finished".

Starting at 12:16:

COURT: Oh, the clerk will give you the times on this so that should wish you to order up a CD for $25 bucks from the clerk upstairs you'll have it on the revision motion that I'm sure she's going to attempt to file.

LUCE Thank you your Honor

COURT: You're welcome.  So, she can file a motion for revision and she can file a notice of appeal, which I can't prevent her from filing, but at least in terms of motions in these courts, I've decided that she's finished.

Background: My late-mother visited Luce & Associates law firm on November 3, 2011 with the intent to write a will; she was terminally sick and her doctor ordered that she get her affairs in order.  Four years after her passing, an alleged community property agreement surfaced and was then recorded; no heirs have been able to inspect the original instrument.  She was an heir to a large estate prior to her marriage which remained separate property and is still separate today (State of Colorado Treasury is reporting unclaimed funds of her separate property).  I attempted to get a ruling of intestacy, the short form of probate, twice and was dismissed.  Therefore, under Commissioner Velategui's own direction, filed to open up proper probate, provided notice to all heirs, there were no objections, and received letters of testamentary.  Two months following this award, Luce & Associates law firm disputed this award and asked the Court to appoint the surviving spouse.  There was no objection by any party.  The matter under revision before Judge Ruhl was to compel compliance mediation - to get it out of the court system- and Judge Ruhl denied to hear the argument. It is Luce & Associates who is accumulating their own attorney fees by bringing the matter to the courts when all other parties which to resolve in private mediation.  The award of over $24,000 did not include any type of itemized statement but did include attorney fees to respond to a bar complaint back in July 2016; these fees were never taken out on the record (the $256 was from 2017).

How can an attorney be awarded this amount of money by an heir by doing no work?  His client was not even awarded the Letters of Testamentary until August 14, 2017; therefore he had no standing to bring this motion forward at all.  He continues to be negligent and has not sent out the Notice of Appointment either.

The members of the Washington State Judicial Commission must take action to ensure the impartiality in our courts and that a fair probate can be had in the Washington State Courts.

Is the Law Library Board a Judicial Function of the Courts?


"The law library board performs a judicial function.  It has from the time the bar was formed.  At the time that people didn’t have computers, in my day, at the time before there were computers, you went to the law library as judges to find the law...

It was the way in which law was dispersed to the people.  It was the way in which ruling judges found the law they needed for purposes of their work.

Law libraries In Lewis County were behind closed doors. They were up on the 2nd floor of the historical courthouse and they were administered exclusively for the judges and the members of the bar.  That was the judicial function that they performed.  The fact that today we have computers that provide access to the law so that no one, many young lawyers, never knew what it was like to have to go to the law library to find the law.  The purpose of the law library was to provide judges with access to the bar access to the law.  That is a judicial function" -

King County Clerk rejects public records request?

Very bizarre... King County Clerk's office rejected my letter to ask whom the administer of my late mother's estate. They wrote a hand written response that I needed to send in $20 deposit.  I will send back with $20 then. Beautiful story

This is an incredible story I wanted to share (actual names have been changed for privacy) 

My friend Carlie from work (Angel's mom, the cute puppy) go walking every afternoon with our dogs and talk about everything and have become good friends. She listens to me talk about all the pains and abuses I've endured in court and she reminds me she doesn't know anyone stronger than me and admires everything I've done. 

She has bills to  pay and it's been tough for her and her daughter these past months to pay bills. Last week, she told me how embarrassed she was for not having money and had to call her ex and borrow money for her to pay rent. She couldn't make ends meet and we brainstormed up ways for her to get money (ie loan off her 401K, etc).  We didn't come up with any real ideas. 

This morning, Carlie swung by for a morning walk, she was frazzled and smiling.  She had to tell me something.  An attorney called her to tell her she was named as heir to a part of the Dayton estate and they were finalizing probate. She nearly forgot she was part of the Dayton family as her dad ventured away from the family to do his own thing and since passed away.  They did not have to proactively call her to let her know she was an heir and could have simply did a back-door deal, swept it under the rug and divided between the remaining beneficiaries.  Her aunt stood up, however, during probate and demanded that Carlie's dad get his fair share by way of giving it to his two children. 

We walked to South Lake Union and she danced around with so much joy, in remembrance of her father. We then sat down to talk about what my mom meant to me and what her dad meant to her.  She often has said I am one of the strongest people she knows, admiring my strength.  She said that she truly believed that what I had been doing in the Courts for justice was the sole reason that she got the call for her fair share of inheritance and money when she needed it most. 

She then told me what it was like to spread her dad's ashes along Seattle and by the Space Needle and why it was important to move back home as she felt his spirit is there.  It was nice to hear a proper probate and honor of one's life, the importance of spreading ashes as closure.  She asked if hearing her news was hurtful for me, given my court challenges.  I told her it was just the opposite - it was one of most inspiring, beautiful and comforting stories I had ever heard and was so happy for her. It felt like mom and her dad were before us during this morning walk, or some type of angel over us, there was definitely some type of spirit there. 

At that moment, I realized that I will never be able to spread mom's ashes in the way she intended to and accepted it this fact. I realize the spreading of the ashes is only a physical action.  Living a good life is what mom would have wanted for us and this in turn, spreads a little bit of her spirit everywhere, something that ashes would never do.  Fighting for truth and justice in her honor has been tough and to be thanked for it really meant a lot to me today. 

Today was filled with deep and good emotions and provided some more closure for me, realizing and accepting that I am strong and mom would be so proud of us both right now for all that we have done.  

How cool is it that Carlie is a Dayton? She had been following all the Benedict family legacy this whole time and had forgotten her own roots.  I asked her if she was going to change her name to Dayton now and she said no, she has already changed it too many times from two different marriages and didn't want to again. That was funny. 

Inspiring and beautiful.  I love you mom, miss you, and give my regards to Carlie's dad whom l have only met in spirit and by way of his courageous daughter.

Phone call to detective Jeff Nolta, city of Fife Detective, follow up email

Mr. Nolta,

This is Heather Benedict confirming I called your office this morning and left a message requesting time to seek counsel before you complete your investiagation. 

I am a victim of identity fraud and have reported this to the FTC, FBI and local police department; (example of ID theft outlined email below where someone has set up an email and posed as me and contacted my cousin, David Hippensteel.) I am not sure how much of my report I need to share with you and would like to consult an attorney before doing so. I have also passed on your information to federal, local and state law enforcement agencies currently assisting me and they may be in contact with you today as well.  Hopefully you can cooperate with their open investigations too. 

As of 7:40PM last night, i now understand your investigation involves Ken Luce, whom was the city of fife's judge for 20 years.  You being employed by Fife, am uneasy about your bias and favoritism towards him, which is why I seek an attorney. I am not a resident of Fife and do not frequent your city. 

Additionally, given the recent sad news of the police shooting in Minnesota of an innocent blonde 40 year old single Caucasian female from Australia (similar to myself), am somewhat even more fearful to talk to any police officer and at random, especially one deployed by Ken Luce who has stated to me and before two other witnesses that it easier to shoot (kill) an opponent [than fight them in court].  I have testified to his statement as a public declaration in the King County Superior Court.  

I am currently part of the WA State Address Confidentiality program and a victim of domestic violence. I find your abrupt email from yesterday somewhat harassing and intimidating.   Common courtesy would be to send a letter, set up a time to talk and disclose my legal rights. You have not done this.  

While I seek to find an attorney this morning am awfully frightened of you, as you could be covering up Mr. Luce's own criminal activities on his behalf, which may go beyond Id theft  and could include concealing my late mother's will, elder abuse and undue influence.  Is this investigation just a distraction from the real criminal activities which may have taken place at Luce Law Firm? That is a question and not a statement. 

Please reply to my other email address hjelbenedict@gmail.com. Further, i would prefer to arrange an in-person meeting in a safe location to verify you are not Ken Luce, Jim or Erik Mickelson just pretending to be a detective trying to incriminate me.

Why didn't you take a plea deal with the prosecutor, so the felony would fall off your record? I have exhausted all my legal authority with the Estate and I will no longer be pursuing it. I got a promotion with Amazon.com and need to focus my attention there. .(Huge raise $325,000 per year, plus stock options). I will be paying off all the legal fees that are owed to Mr. Luce. I feel horrible for all the problems I created with my family.  I finally realized that the only thing you can count on is your family. I would love to be back on speaking terms with my family. Having a huge raise does me no good if I don't have friends to share it with. I wish you and I would become friends again with Jim. He is getting up there in years and I want to see him enjoy his retirement. I know Fran would be very happy if you mended your problems with Jim. Maybe we could all take a trip back up to the Iron Range in Chisholm.

Fife Police detective Jeff Nolta outreach

This email came in today from the Fife Police detective and omits any content or reason for his inquiry.  Sounds official but weird. Maybe he's investigating undue influence? On second thought, according to Mr. John Nolta, at 7pm this evening, not even 12 hours since he first emailed me, Mr. Nolta states:
"This concerns a criminal allegation made by Ken Luce. I am not able to conduct an interview via  email. I will complete my investigation without your statement.

Judge Barbara Linde March 31, 2017 ruling (now under appeal)


March 31, 2017 King County Superior Court, Seattle, Washington.  Honorable Judge Barbara Linde ruling on the Estate of Leeanna Ruth Mickelson and against her daughter to award a bullying attorney $5,000 in sanctions against an heir and $2,300 in attorney fees.  Her decision is now pending the Court of Appeals, Division I.  Can one heir bully another heir under probate and be sanctioned?  It was the bullying attorney, Luce & Associates, whom was hired by the decedent and certainly cannot see the last wishes would be to not have a will and to have her children be sued by the attorney she trusted and by her own spouse.

Pro se individual wants answers from the WSBA for frivolous complaint

Ms. Linder,

Thank you for the time extension to respond.  

In my opinion, the complaint filed is without merit and holds no substantial allegations and should be dismissed.  I am not an attorney and have only represented myself. Mr. Luce has provided no evidence to suggest otherwise.  I would ask that your board address these questions for me, so that I may properly respond:

1.) On what merits has the claim allowed to continue? Specifically, what RCW(s) are being violated so that I may appropriately respond? 
2.) Can you send me all of the correspondence between your board with Mr. Luce, including emails and call logs? If not, can you direct me whom to contact to request this information?
3.) Are there any conflicts of interest amongst your board which should be disclosed?  Specifically, Mr. Luce is a 33 degree Freemason and I would ask any other member of the freemason fraternity recuse themselves on this matter.  Mr. Luce's high ranks could demand a fraternity brother to rule in Mr. Luce's favor and disregard Washington State law and this frightens myself. 
4.) May I attend your July 20, 2017 meeting and make public comment?  Are your meetings open to the public and may they be video recorded for social media? Where may I access minutes from prior meetings?

Mr. Luce is currently under investigation with the Washington State Bar Association.  He has practiced law for 50 years and appears to be retaliating against a pro se individual out of desperation for his own wrong doings in handling my late mother's probate by filing this complaint with your board. His predatory and abusive actions against myself have taken form of an intentional infliction of emotional distress.  My goal is to minimize the trauma he has already caused me and to avoid any future inflammation on my personal life.   

I do believe in freedom of speech and in government transparency. As such, I will treat this complaint and investigation with the same transparency I have throughout this journey to expose corruption and fraud related to my late mother's probate.  Thank you for your time and assistance.

I am a victim of domestic violence and participate in the Washington State Address Confidentiality program and mail is delayed an additional 2 business days and given the holiday weekend, am not able to make your deadline to respond 14 days before your July 20, 2017 hearing.  I am not an attorney but a pro-se individual and an heir to my late-mother in representing myself through her probate proceedings, in which Mr. Luce was hired to oversee and should be managing without any partiality and privately through mediation and not the court system for his own profit.  I have asked him and the court to settle matters through mediation and not through litigation, Mr. Luce refuses to do say and enjoys wasting people's time. 

It should be noted that there is an open investigation with the Washington State Bar Association Office of Disciplinary Counsel against Mr. Luce's bar #3081.  It is my belief that he is retaliating against me with this complaint as he has practiced law for over 50 years and somehow believes he is above the law.  It is also my understanding that Mr. Luce's daughter, Al'an Luce, once employed at the Luce Law Firm is now employed within the Attorney General's office who oversees these types of complaints.  My concern is there is already a conflict of interest within the Practice of Law Board which will favor Mr. Luce and it frightens me that I do not have a fair time frame to respond nor to seek legal counsel. 

It is my understanding, while I am not an attorney, the right to freedom of expression is recognized as a human right under article of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights.  Article 19 of the UDHR states that "everyone shall have the right to hold opinions without interference" and "everyone shall have the right to freedom of expression; this right shall include the freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice."

I hereby ask for 30 days from today's receipt to respond to your complaint.  Your July 20th hearing would require that I submit a response by the end of today (14 days in advance) and even a layman would agree that it is impossible and unjust. The complaint appears to be over 100 pages and I have not even read its entirety. I work full time and am not a lawyer. 

I kindly ask you consider my request for a 30 day time frame (July 30, 2017 deadline) to properly respond to the allegations before me and for you to enter a decision on my continuance request by Thursday, July 6, 2017.  Further, I request to attend in person your July 20th, 2017 meeting, please confirm the location meeting place and time.

Response to Wa Attorney Licensing Board

Written via email in response to attached complaint of Mr. Kenyon E. Luce's confusion that I am an attorney.  I am not, just representing myself.

Monday, July 3rd hearing: one-sided petition for attorney fees


Attorney Ken Luce visits the King County Superior Court in hopes to pick up a $62,000+ paycheck in way of an order from his Freemason buddy, Carlos Vilategua.  The morning of July 3rd, Commissioner Velategui told Mr. Luce to 'come on up, I'll sign your order', but a change of heart all of a sudden:  the daughter whom he's seeking $62,000 from provided a well documented and thorough working copy of Mr. Luce's negligence as an attorney, including: Notice of Investigation (Luce is being investigated by the Washington State Bar Association) and Notice of Court of Appeals Division I.  Yes, that is correct.  For those following this matter, this is now the 3rd filing in a Court of Appeals in Washington State.  When will Mr. Luce say, enough is enough, and agree to family mediation (which has always been the preferred route by all heirs).

Motion for Revision - King County
